Terms of Service

These terms are an agreement between you and Winmap (“Winmap”, “we”, “us”) for your use of winmap.io and the Winmap app (the “Service”). By creating an account or using the Service you agree to them. If you use Winmap for a company, you agree for that company and confirm you can do so.

1. Your account

You need an account to use Winmap. Give a real email address, keep your password private, and tell us at hello@winmap.io if you think someone else has access. You are responsible for what happens under your account. You must be at least 16 years old to use the Service.

2. Workspaces and teammates

Your boards live in workspaces. The person who creates a workspace is its owner and controls its plan, billing and members. Anyone the owner invites can see and edit that workspace’s content. Owners are responsible for who they invite.

3. Plans and payment

• Winmap has a free plan and paid plans (currently Gold at $39/month or $390/year, and Platinum at $99/month or $990/year). A plan belongs to the account that owns the workspaces and covers every workspace it owns, up to the plan’s limits. Prices are in US dollars, and taxes are added where they apply.
• Platinum accounts can buy extra AI credits (500 analyses for $50), which are used once the monthly allowance runs out. Credits don’t expire while your account is open, can’t be transferred or exchanged for cash, and aren’t refunded unless the law requires it.
• Paid plans renew automatically at the end of each monthly or yearly period, and the card on file is charged until you cancel. Payments are processed by Stripe; we never see or store your full card number.
• You can cancel at any time from Plan → Manage billing. Your plan stays active until the end of the period you’ve paid for, then your account moves to the free plan. Workspaces and teammates you already have stay, but you can’t add more than the free plan allows. We don’t give refunds for partial periods unless the law requires it.
• If a payment fails we may move the workspace to the free plan. Your content is kept.
• We will tell you at least 30 days before a price change affects your plan. The new price applies from your next renewal.

4. AI analysis

When you attach an ad file and ask for AI analysis, the file (or frames from a video) and your workspace’s saved variable names are sent to our AI provider to suggest tags and a summary. Each plan includes a monthly number of analyses, which resets each calendar month and doesn’t carry over. AI suggestions can be wrong; check them before relying on them.

5. Your content

You own what you put into Winmap: your ad files, variables, metrics and notes (“Your Content”). You give us permission to store, copy, display and process Your Content only as needed to run the Service for you, including sending it to the service providers listed in our Privacy Policy. You confirm you have the rights to upload Your Content. We don’t sell Your Content or use it to advertise.

6. Acceptable use

Don’t use Winmap to:

• break the law or infringe anyone’s rights, including by uploading content you don’t have the rights to;
• upload malware or anything meant to harm the Service or other users;
• try to access accounts or workspaces that aren’t yours, or probe, scrape or overload the Service;
• get around plan limits, including AI analysis limits, or resell the Service without our written permission.

7. Our service

Winmap, its software, design and brand belong to us. We may improve, change or stop features over time; if we make a change that materially reduces a paid plan, we’ll tell you in advance. We work to keep the Service available but don’t promise it will be uninterrupted or error-free. If you send us feedback, we may use it without owing you anything.

8. Ending your use

You can stop using Winmap at any time and ask us to delete your account at hello@winmap.io. We may suspend or close accounts that break these terms or put the Service or other users at risk. When a workspace or account is deleted, its content is removed from our systems within 30 days, except where we must keep records (for example, billing records) by law.

9. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Winmap shows patterns in the data you enter; it isn’t advice, and we don’t guarantee any advertising result.

10. Limit of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

11. Indemnity

If someone makes a claim against us because of Your Content or your breach of these terms, you agree to cover our reasonable costs of dealing with it, including legal fees.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, and you and we agree to their jurisdiction. If you live somewhere whose law gives you rights these terms can’t take away, those rights still apply.

13. Changes to these terms

We may update these terms. If a change is significant, we’ll tell you by email or in the app before it takes effect. Continuing to use Winmap after that means you accept the updated terms.
